Gazimagusa Municipality Impose Sanctions On Those Who Break Rules
Gazimağusa (Famagusta) Municipality started to impose sanctions on Monday, October 14, within the framework of the powers granted to the municipality by the laws under the heading “Crimes and Penalties” of the Municipalities (Amendment) Law to ensure peace, health, and well-being in the city.
Those who do not comply with the rules in Article 122, Paragraph 1, and the traffic rules in Paragraph 2 of the Municipalities Law will be fined by the relevant unit of Gazimağusa/Famagusta Municipality and the Police and Traffic Police teams.
The offenses that require fixed fines are as follows;
In places where all kinds of spring water to be drunk are packaged and/or where the substances to be eaten or drunk are made, produced, packaged, sold, stored, used or made available, the penalty for non-compliance with the rules and conditions of cleanliness or health and/or the detection of substances that have expired or whose usage and consumption date has expired or which do not comply with the standards determined by the relevant legislation as a result of the analysis, or which are harmful to health to be eaten or drunk, is the minimum wage.
The penalty for opening workplaces that need permission from the municipality without permission is half of the minimum wage. The penalty for non-compliance with the health conditions of employees in workplaces is the penalty is the minimum wage.
Penalty Imposed for indiscriminate disposal, dumping or storage of garbage, debris, industrial waste and construction debris without the necessary permission is the minimum wage.
The penalty for not complying with the sanitary conditions in public buildings is half of the minimum wage. The penalty for the uncontrolled discharge of septics or wastewater of residences and workplaces into the external environment, without a work and discharge permit or for pouring septic wastes outside the places determined by the municipality is the minimum wage.
The penalty for damage to trees or cutting trees without permission is half of the minimum wage in fields, sports fields and facilities, parks, gardens and green areas, picnics, viewing, and promenade areas.
The offenses that require fixed fines are as follows;
Penalty Imposed for the establishment of pens, dairies, and poultry houses within the boundaries of the Municipality without permission from the Municipality or for feeding more than the specified number of cattle, sheep, poultry, or poultry is the minimum wage. The penalty for not remedying the specified ailment within the period specified in the notice is half of the minimum wage.
The penalty for failing to fulfil their obligations to notify the relevant Municipality in writing within fifteen days starting from the date of employment, the name, surname, profession, residence, and the amount of wages paid by real and/or legal persons and partnerships with real and/or legal persons who employ contractors is half of the minimum wage.
Penalty Imposed for the failure of real and/or legal persons and partnerships employing contractors to fulfil their obligations to deduct the finalized occupational tax from the wages of the undertaker and deposit it to the Municipality is half of the minimum wage.
The penalty for opening the workplace without obtaining a professional permit or not renewing the permit or not working in accordance with the purpose of the professional leave is the minimum wage.
Penalty Imposed for opening or operating workplaces whose opening is subject to a permit without prior permission or for not renewing the permit related to the conditions of employment is the minimum wage.
The penalty for peddling goods or similar matters without prior permission from the municipality is 20 percent of the minimum wage.
Under the rules of the Animal Welfare Act and the Identification and Registration of Animals and Businesses Act, the penalty for engaging in behaviour that requires sanctions by the municipality is the minimum wage.
The penalty for employers not issuing a health report card to their employees is half of the minimum wage.
Penalty Imposed for hanging an advertising sign/sign without permission from the municipality is the minimum wage.
The offenses that require fixed fines are as follows;
The owner or operator of the touristic facility shall be fined half of the minimum wage for not reporting the information about the overnight stays made in the tourist facility within a month to the Municipality and/or reporting it in a false and/or untruthful manner and/or not providing the information requested by the Municipality and/or not allowing the inspection to be carried out.
The penalty for any person failing to obtain and/or refraining from obtaining the necessary permit to receive water and/or installing pumps in drinking water pipes before or after the meter and/or using illegal water and/or failing to maintain and/or damaging the water clock and/or wasting water in vain is a minimum wage.
Any natural and/or legal person working in vacuuming or trenching services without obtaining the necessary permission; The penalty for the owner, user, and/or disposal of immovable properties that overflow sewage wells and/or create an unsanitary situation is a minimum wage for the failure of the owner, user and/or owner of the existing pollution immediately and/or within the given time from the notification of the Municipality.
Without obtaining the necessary permission, the occupation of any square, street, road, street, sidewalk, park, or green area belonging to the Municipality, public areas, or similar places in relation to construction works or leaving commodities in these areas without permission, and placing goods in these areas is twice the amount of the fee.
Any person, State, institution, organization, or owner of the building; The penalty for not connecting to the sewer network even though it is mandatory to connect to the sewer network, or connecting to the sewer without obtaining permission from the Municipality and/or giving waste that will not be given to the sewer network is the minimum wage.
Under the Environment Act, the penalty for making noise in violation of environmental legislation is the minimum wage.
Incorrect Parking Will Not Be Tolerated Either
To ensure a safer traffic flow on the roads in our city, sanctions will also be imposed in case of non-compliance with the vehicle parking rules, which we all know but cannot comply with in practice.
If the Traffic Police teams detect faulty parking, vehicle drivers will be fined a fixed fine of 1010.90 TL, which is 2.5 per cent of the minimum wage.
Traffic offenses in the Municipalities Law are as follows;
- Delaying and obstructing vehicle passages.
- Failure to obey the instructions of a uniformed law enforcement officer.
- Failure to comply with a ‘No stopping, no waiting’ or ‘No parking’ sign.
- Parking within 9.15 m of corners and road signs.
- Parking within 45.70m of traffic lights or beacons.
- Parking within 13.70m from the pedestrian crossing and bus stop.
- Parking on the double yellow line. Parking at the entrances and exits of fire stations, police stations, schools, mosques, churches, hospitals, test houses, theater parks, bus stations.
- Parking a car on the sidewalk.
- Failing to show ID, driving license and documents belonging to the vehicle despite the request of the law enforcement officer.
- Violating the parking period.
- Parking in the pedestrianized zone.
- Not paying for parking.
- Parking in a disabled parking space.
- Parking on the bus platform.
- Parking at the taxi rank
